TIMCO Aerosystems a division of TIMCO Aviation Services, Inc. (TIMCO) Response to European Union (EU) REACH Regulation
As one of the world’s leading manufacturers of aircraft seats. TIMCO Aerosystems must continuously rise to the challenge of complying with international laws and regulations that change on a regular basis.
Regulation (EC) 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) came into force in 2007[1] and has placed stringent requirements on manufacturers and importers of chemicals, mixtures and articles, to ensure a high level of protection of human health and the environment (the “REACH Regulation”). These requirements included pre-registration of phase-in chemicals before 1st December 2008 and full registration of chemicals by a deadline determined by tonnage, with the first deadline on 1st December 2010 for high tonnage chemicals.
In response to the REACH Regulation, TIMCO Aerosystems has ensured that its requirements are well understood by its subsidiaries and that any obligations REACH imposes on our customers with EU operations are addressed in a timely fashion.
Products manufactured by TIMCO Aerosystems are considered to be articles with no intended release of chemicals during their normal use under the REACH Regulation and do not contain substances of very high concern. Therefore, under Article 7 of the REACH Regulation, registrations or notifications are not required with the European Chemicals Agency (ECHA) at this time.
Additionally, chemicals and preparations supplied to our EU customers all fall below the 1 tonne per year REACH threshold and contain no substances of very high concern. Therefore, under Article 6 of the REACH Regulation, registrations or notifications are not required with the ECHA at this time.
TIMCO Aerosystems is committed to providing safety data sheets or other relevant information relating to safe use of products in accordance with Articles 31-34 of the REACH Regulation. In the event that any of TIMCO Aerosystems’s products become subject to registration or notification under the REACH Regulation, all of our EU customers will be contacted in a timely manner in order to provide regulatory assurances and relevant information.
To address any further regulatory issues that may arise in the EU as a result of the REACH Regulation, TIMCO Aerosystems has appointed Blue Frog Scientific Ltd., UK-based experts in EU chemicals regulation, as our representatives in the EU to support TIMCO Aerosystems’s REACH regulatory compliance strategy.
